 Bankruptcy is Not the Only Option

Our debt settlement or negotiation services are not the same as Consumer Credit Counseling, whereby you pay your creditors back in full with an adjusted interest rate over five to seven years.  Our team executes genuine debt negotiation plans, abolishing 40- to 60 percent of the money you owe.

Believe it or not… there are many clients who contact us after they have already spent up to 2 years with Consumer Credit Counseling programs on the mainland. They end up finding that they are not any closer to becoming debt-free.

Generally, if you are eligible for our Debt Settlement program, you are likely to get remarkable settlements in principal and interest. Moreover, you do not file bankruptcy and still eradicate a great part of your debts within 30, or even fewer months.

Bankruptcy should be a last resort option to get you out of debt so deep that you cannot possibly recover without it. If we feel that you are in need of bankruptcy then we may be able to help you through that process, but we would like to see if there is a way to settle your debts before we fall back on that option.

We Deal with Your Creditors Instead of You

Yes, you hear right. When you are working in paying your debts pack via our Debt Negotiation program, collection agencies are forced to communicate with your debt settlement attorney on your behalf.  So, you can have great peace of mind, and get relief from the stress of dealing with creditors.

There are laws that prevent collectors from harassing you. Those laws state that if you gain representation through a lawyer then any calls they make about your debt must be done through your lawyer. As such, if you hire us, then we may be able to make those calls stop.

What Actions Collections Agencies Can’t Take?

Well, a collection agency must avoid taking the following actions under the “Fair Debt Collection Practices Act”-

Third-party interactions

The collection agency can communicate with third-parties to find the debtor.  But they cannot discuss the reason they are calling and discuss the debtor’s delinquencies.  Moreover, collection agencies cannot interact with third-parties through correspondence using symbols or words that deceive their collection purpose.

For example, they cannot call a third party pretending to be someone else to try and gain information about you. That would be deceitful and evidence of a collector doing this would lead to a hefty fine against them.

Debtor interactions

Collection agents cannot communicate with debtors after 9:00 pm or before 8:00 am. In simple words, they cannot contact debtors at inconvenient place or time. If you are receiving calls during times that are considered “unusual” then they are breaking the laws set by the Fair Debt Collection Practices Act and can be heavily fined for doing so.

Related to this, a debt collector cannot come to your place of work to try and collect your debt from you. They can call you at work, but if you request they do not call you while you are at work then they are required to stop.

This is equally true if you have a job where you cannot possibly take a call from a debt collector. Some employers will not allow you to take personal calls while at work and in other cases people will be working a job where it is not possible to be taking a personal call while working such as restaurants, hospitals, or schools.

Abuse

Collection agents cannot abuse or harass debtors at all. In other words, they cannot use violence or threaten debtors, and they are not allowed to use profane language. Plus, they cannot publish the name of the debtor on a “blacklist”.  In fact, collection agents cannot interact with debtors directly if an attorney represents that debtor or the debtor provided permissions to do.

Know your rights. Do not let debt collectors put you into a state of fear. They are not allowed to do it and you should not let them do it.
